Acceptance of Terms
By accessing or using PainRadar ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time; continued use of the Service after changes constitutes acceptance of the updated terms.
Use of the Service
PainRadar provides market research and pain-point discovery tools that analyze publicly available discussions (e.g., Reddit, X) to help you understand customer needs and market gaps. You may use the Service only for lawful purposes and in accordance with these terms. You are responsible for ensuring your use complies with applicable laws and the terms of any platforms we source data from.
Account and Subscription
To access certain features, you may need to create an account and subscribe to a plan. You must provide accurate information and keep your account secure. You are responsible for all activity under your account. Subscription fees are billed in advance and are generally non-refundable unless otherwise stated or required by law.
Acceptable Use
You agree not to use the Service to: (a) violate any law or third-party rights; (b) distribute malware or attempt to gain unauthorized access to our or others' systems; (c) scrape or automate access in ways that violate our policies or applicable platform rules; (d) use the Service to harass, defame, or harm others; or (e) resell or redistribute raw data or insights in a manner that competes with PainRadar without our consent. We may suspend or terminate access for violations.
Intellectual Property
PainRadar and its content, features, and technology (including software, design, and branding) are owned by PainRadar Inc. or its licensors. You receive a limited, non-exclusive license to use the Service for your internal business purposes. You do not acquire any ownership rights in the Service or our content. Reports and insights you generate for your own use remain yours, subject to these terms.
Data and Privacy
Our collection and use of personal and usage data are described in our Privacy Policy. The Service processes publicly available content and your queries to produce insights. We do not guarantee the accuracy or completeness of sourced data. You are responsible for how you use insights and for complying with privacy and data protection laws applicable to you.
Disclaimers
The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that insights will be accurate or complete. The Service is a research tool; you use insights at your own risk.
Limitation of Liability
To the maximum extent permitted by law, PainRadar Inc. and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claims related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Termination
We may suspend or terminate your access to the Service at any time for breach of these terms or for any other reason. You may cancel your account or subscription in accordance with our then-current process. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability) will survive.
Changes to the Service and Terms
We may modify the Service or these terms. For material changes to the terms, we will provide notice (e.g., by email or a notice in the Service) and, where required by law, obtain your consent. Your continued use after the effective date of changes constitutes acceptance. If you do not agree, you must stop using the Service.
General
These terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction. If any provision is held invalid, the remainder remains in effect. Our failure to enforce a right does not waive that right. You may not assign these terms without our consent; we may assign them in connection with a merger or sale of assets.
